What this means for your business
A U.S. business can seek legal assessment of a claim against a German debtor before obtaining a judgment. The recovery route depends on the contract, evidence, jurisdiction, limitation periods and the debtor's assets. A valid claim does not guarantee collection.
Start with the claim and the debtor
We review who owes the money, what was agreed, whether performance can be shown and what objections have been raised. Governing law, jurisdiction, limitation periods and any arbitration clause affect the options.
A sound claim does not guarantee payment. Known assets, insolvency concerns and the likely costs of recovery need to be considered alongside the legal merits.
- Contract, purchase order or agreed terms
- Invoices, delivery or performance evidence
- Correspondence and any dispute or payment promise
- Debtor's legal name, location and known assets
Choose a proportionate recovery route
Depending on the case, the next step may be a payment demand, settlement negotiation, suitable payment-order proceedings or a contested claim. We explain the proposed stages and seek agreement before expanding the work.
Where insolvency proceedings are relevant, creditor rights and the appropriate filing route require separate consideration. We do not promise a recovery amount or a fixed completion date.
Move from a title to actual recovery
Once an enforceable title is available, we assess appropriate enforcement steps against assets in Germany. A U.S. judgment or foreign arbitral award needs its own recognition or enforcement analysis first.
You receive an explanation in English of the recommended action, costs and practical limits. Any success-related fee arrangement must be assessed against the applicable German rules.
